Illegal buildings to be demolished, compliance after the fact no longer allowed

The Government decided via an emergency ordinance to eliminatethe possibility of owners, builders and developers who infringed onurban plans to get the so called "urban plans to ensure complianceafter the fact" for buildings that do not comply with the plans.The government drastically limited the possibility of the publicauthorities admitting the Zonal Town Planning (PUZ) financed byprivate investors or by landowners, which currently allow the PUZto stray from the General Urban Planning (PUG) for areas of 1,000square metres.
The emergency ordinance which modifies law 530/2001 on setting upthe territory and urbanism sets out clearly that the state canimpose limitations on use of the property.
"The state, via the public authorities, has the right and the dutyto impose limitations on the use of property in order to ensure theconditions for sustainable development and for complying with thegeneral interest, under the law."
Development minister Elena Udrea said on Wednesday evening, afterthe government meeting, that the new form of the law no longer leftthe developer or the investor the possibility of securing approvalfor a new zonal town planning or documents to make the buildingcomply with the law after the fact.
