Illegal buildings to be demolished, compliance after the fact no longer allowed
The Government decided via an emergency ordinance to eliminate
the possibility of owners, builders and developers who infringed on
urban plans to get the so called "urban plans to ensure compliance
after the fact" for buildings that do not comply with the plans.
The government drastically limited the possibility of the public
authorities admitting the Zonal Town Planning (PUZ) financed by
private investors or by landowners, which currently allow the PUZ
to stray from the General Urban Planning (PUG) for areas of 1,000
square metres.
The emergency ordinance which modifies law 530/2001 on setting up
the territory and urbanism sets out clearly that the state can
impose limitations on use of the property.
"The state, via the public authorities, has the right and the duty
to impose limitations on the use of property in order to ensure the
conditions for sustainable development and for complying with the
general interest, under the law."
Development minister Elena Udrea said on Wednesday evening, after
the government meeting, that the new form of the law no longer left
the developer or the investor the possibility of securing approval
for a new zonal town planning or documents to make the building
comply with the law after the fact.
