The Bucharest Court of Law on Monday delivered its ruling stating that Victor Ciorbea may not be PN?CD (National Christian Democratic Peasant Party) leader. The Court dismissed the PN?CD motion to ascertain the merger by absorption with the National Christian Democratic Alliance (ANCD) - Victor Ciorbea's former party.
Therefore, the decision of the Convention on August 14, which elected former PM as leader, becomes null and void. PN?CD will challenge the ruling in the Court of Appeals.
Following the ruling of the Bucharest Court of Law, PN?CD remains registered in the political party register as it was prior to the decisions of PN?CD's Permanent Delegation on August 13, when the statute was modified and when the motion that enabled Victor Ciorbea to win the PN?CD's leadership the next day was registered.
The Court also dismissed ANCD's request to be struck off the political party register, which means Ciorbea is still leader of this organisation but not of PN?CD.
The motion for ascertaining the nullity of the two parties' merger was filed by the dissident PN?CD faction headed by Andrei Marga, Vasile Lupu and Catalin Chirita on August 9.
The three leaders claim Victor Ciorbea has simultaneously signed various documents, including the merger decision, as both PN?CD leader and as ANCD leader, which violates the Party Law.
