Court cancels Tarom-Omniasig contract

The Bucharest Court of Law has cancelled the tender that had appointed Omniasig the insurer for national airline Tarom's fleet. The Court delivered the ruling following a complaint filed by another insurance company, Ardaf.



Ardaf said that it had been disqualified following the inclusion of the "similar experience" criterion in the job specifications book. The insurer also claimed that the said criterion failed to meet the market competition standards and the law on public acquisitions.



Tarom awarded the insurance contract to Omniasig for the October 1, 3003-September 30, 2004 interval, following a tender run last September on the Romanian Commodities Market (BRM). Tarom paid an insurance premium worth $6.2 million.



Ardaf filed a complaint against Tarom and the Romanian Commodities Market for having infringed upon the public acquisition procedures. According to the Ardaf officials, the Labour Conflicts and Labour Litigations section of the Bucharest Court of Law consequently cancelled the Tender Commission 's decision to award the contract to Omniasig. "The ruling delivered by the Court of Law proves that we made the right move," said Ardaf president Steluta Racolta. The ruling is final and executory, according to Ardaf representatives.



However, officials of the Romanian Commodities Market claim "there is no final and irrevocable ruling in this particular case." sorin.pislaru@zf.ro
