Five insurance company bosses fined by CSA

The Insurance Supervision Commission (CSA) slapped a fine on five insurance company managers worth one net salary, because some of the brokers or agents that work with those companies were selling auto liability insurance policies (RCA) on the streets. The managers fined by the CSA are Boris Schneider from Asirom, Dumitru Ceraceanu from Asiban, Bogdan Stan from Asitrans, Radu Mustatea from Astra-Uniqa and Constantin Toma from Omniasig.
Asirom, Asiban, Asitrans and Astra-Uniqa bosses challenged this decision, saying they had notified their brokers and agents about the new stipulations of the CSA, while Omniasig officials did not return any comment.
In mid July, CSA chairperson Angela Toncescu prohibited the sale of mandatory auto liability insurance policies on the streets, at street stands or in cars in order to reduce the errors in the Cedam database, which includes information about every RCA policy issued by insurers. The CSA has been conducting inspections ever since to identify the companies whose brokers or agents sell RCA policies in places that are not specifically designed for this purpose. These inspections resulted in a series of written warnings sent by the CSA to companies, with the last of these penalties coming in the form of one net salary for the bosses of the insurance companies, a month ago.
According to the legislation in force, the Commission may penalise managers of the insurance companies with one to six net salaries (calculated in line with the net salary in the month before the infringement was found).
Dumitru Ceraceanu, Asiban general manager says he should not normally be penalised because his company notified the brokers and agents it works with that it is prohibited to sell RCA policies on the streets. He did not pay the fine and challenged CSA's decision.
"It's not possible to take steps to put an end to the sale of RCA policies on the streets right away. More time is needed to apply the decision of the CSA," Ceraceanu explains.
Radu Mustatea from Astra-Uniqa, in turn challenged the decision of the CSA, but paid the fine.
"We do have a responsibility, but we did our best to uphold CSA's decision to prohibit sale of RCA on the streets. Still, we are met with the harsh reaction of the brokers and, in some cases, had to go and take the contracts by force," Mustatea says. "I challenged the decision of the CSA to fine me, but got a negative response. I can challenge it again in the Court of Appeals within 30 days," says Astra-Uniqa's manager.
Another manager that challenged the fine he received from the CSA is Bogdan Stan, from Asitrans. "Asitrans understands CSA's actions are taken in order to make the process of selling insurance policies professional and civilised. To that end, we trained our own sales force and notified every broker. Unfortunately, we feel the CSA rushed to make the decision to penalise several insurance companies without checking the steps taken by these companies in view of implementing legislative modifications," Stan says.
